1. About these Terms and Conditions

In these terms and conditions ‘we’ and ‘us’ mean Lateral Marketing & Management Pty Ltd and ‘you’ means the person placing the relevant Order.

The website www.letapeaustralia.com (“Site”) is owned and operated by Lateral Marketing & Management Pty Ltd (ABN 86 077 821 339) (referred as Lateral, “we”, “our”, “us” or the “Company”).

These Terms and Conditions govern the supply of any products ordered by you on the Site and your use of the Site. By using the Site or ordering a product, you agree to be legally bound by these Terms and Conditions.

2. Placing Your Order

To place an Order you must be 18 years of age or over.

You may place an Order, while stocks last by:

  • Filling in the Order Form on www.letapeaustralia.com and clicking on the ‘Submit’ Button;
  • Telephoning us on +61 2 8272 4580 between 09:00 and 17:00, Australian Eastern Standard Time, Monday to Friday (excluding public holidays).

Once You select a product that you wish to order, irrespective of any previous price you have seen or heard, you will then be shown or told (on the Site) the price you must pay in full at the time of ordering

If you discover that you have made a mistake with your Order after you have submitted it to the Site, please contact us immediately. However, we cannot guarantee that we will be able to amend your Order in accordance with your instructions.

When you place an order, you will receive from us a confirmation e-mail. This email will only be an acknowledgement and will not constitute acceptance of your order. We may at our discretion refuse to accept an Order from You for any reason, including but not limited to unavailability of stock. If this occurs we will promptly refund any payment already made by you to your original payment method.

Due to photographic and screen limitations associated with the representation of products, some actual products may differ to a small extent in visual appearance (for example in colour) from the way they appear on the Site.

3. Prices

The price for the Products will be the price indicated on the site.

GST Tax is payable by you at 10%

We reserve the right to change prices without prior notice.

All charges are in Australian Dollars. If you live outside of Australia your credit card company/bank will convert this purchase price to your local currency at the prevailing exchange rate. Note that we have no control on the exchange rate that will be applied.

4. Delivery of Your Order

Unless otherwise agreed by us, we will deliver your jersey to the address as indicated on your Order Form. The other items available for purchase won’t be shipped and will have to be collected on the event day in the event village (Banjo Patterson Park, Jindabyne).

We will use our best endeavours to dispatch your order within the time frame indicated on the Order page. This timeframe is not guaranteed and depends on stock availability and production schedule.

To the extent permitted by law, we will not be liable to you for any losses, liabilities, costs, damages or expenses arising out of late delivery.

You must ensure that you are able to accept delivery of the product/s without undue delay. If you are not, the post may leave a card giving you instructions on either re-delivery or collection from post office.

All risk in the product shall pass to you upon delivery. From the time when risk passes to you, we will not be liable for loss or destruction of the product.

5. Cancellation

We may terminate a Contract if the product is not available for any reason. We will notify you if this is the case and return any payment that you have made. We will refund any money received from you using the same method originally used by you to pay for the product.

6. Faulty Product Returns

If you have received a Product with a defect, please contact us as soon as possible so we can help resolve the problem as swiftly as possible. In order to assist with this process, you may be required to send us images of the damage, defect or fault for preliminary assessment. If the Product is confirmed to have a defect, we will replace the Product or refund the price of the Product to your original payment method. It does not constitute a defect, if in our reasonable opinion, the Product has become of unacceptable quality due to fair wear and tear or failure to take reasonable care.

7Your Right to Return the Products

If you are not satisfied with any Product you have purchased from us, you may return the Product to us and obtain a refund of the price of the Product returned if you contact us within 10 days of delivery of the Product to you. We will not be liable for postage or any other delivery costs incurred by you in returning Products to us. To obtain a refund in this way, all items returned must be in new condition with the tag on.

8. Indemnity

You indemnify and hold us harmless from and against any and all claims, demands, proceedings, losses and damages, made by any third party due to or arising out of your breach of these Terms and Conditions or your breach of any law or the rights of a third party.

9. Governing Law and Jurisdiction

This order shall be governed by and construed in accordance with Australian law.

10 Data Protection Information

Any information which you supply, which you have previously supplied or which we may hold about you in the future may be held on our database which will allow us process your order. The information may also be used for the prevention of fraud and for statistical and research purposes.
